This Privacy Policy applies to the Website www.nexiloans.com, the Nexiloans mobile application, and other related internet-based platforms (collectively referred to as the Website, Services, or App). These are owned and operated by Nexi Fintech Private Limited (hereinafter referred to as We, Us, Our, or Nexiloans), a company duly incorporated under the Companies Act, 2013.

This policy has been drafted in accordance with the Guidelines on Digital Lending issued by the Reserve Bank of India (RBI), the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and other applicable laws, regulations, and guidelines. This Policy governs the manner in which we collect, use, store, disclose, and protect personal and sensitive personal data or information.

1. Consent

You hereby expressly consent to provide the information that may be required in relation to the Services being rendered by us. You acknowledge that we shall collect the information detailed under this Privacy Policy to facilitate lending and non-lending services by partnering with various financial lenders, third parties, service providers, and others, based on your requirement to avail such Services

Nexiloans will only use the information for providing the Services to you. In order to avail of any Services provided by Nexiloans, either by itself or in partnership with other third parties, it is important that YOU READ, UNDERSTAND, ACKNOWLEDGE, AND UNCONDITIONALLY AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS PRIVACY POLICY.

2. Information Collected and Used by Nexiloans

Nexiloans respects the privacy of its Users and strives to embed privacy in all our processes in compliance with the Applicable Laws. We recognize the importance of protecting your personal information as well as the importance of transparency in the way that we collect, use, store, transfer/disclose, and dispose of information derived from your use of our products, services, online portals, and mobile applications.

Such information of the User may include personal details (such as name, address, date of birth, photograph, father’s name, mother’s name, etc.), contact details (such as residential address, email address, telephone/mobile number), business details (such as employment type, business type, industry, employer details), health information (such as disability, medical treatments, surgeries if voluntarily provided), credit and financial information (such as bank name, account number, bank transactions, loans, credit history), and device information (such as location, messages, contacts, call logs, emails, log information, search queries, IP address, IMEI number, crashes, date and time, browser web storage, application data caches, cookies, and similar technologies) (collectively referred to as “Customer Data”).

We may also work closely with affiliates, third-party business partners, technical sub-contractors, analytics providers, search information providers, credit information companies, and account aggregators, and may lawfully receive information about you from such sources. Such information may be combined with information collected on the App and other information as provided in this Policy.

Sensitive Personal Data: For the purposes of this Policy, ‘sensitive personal data or information’ shall have the meaning ascribed under Rule 3 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and may include financial information, health information, passwords, biometric data, and other identifiers.

3. Purpose of Collection

Apart from section 2 above, where we describe the categories of information we collect, we may also use the information for the following purposes:

  • To provide products or services you have requested.
  • To provide information to our partners to assist in making credit decisions about you.
  • To help investigate violations of our terms of use or to defend against legal claims.
  • To disclose information as required for compliance with local law, court orders, or requests from legal authorities.
  • To identify, prevent, detect, or address fraud, money laundering, terrorism, or other crimes.
  • To communicate with you about our products and services by email, SMS, letter, or telephone.
  • For internal audits, risk assessments, and service improvements.

4. Data Retention and Deletion

We at Nexiloans commit to protecting your personal data from unauthorized access, misuse, and disclosure using appropriate security measures based on the type of data and how it is processed. We retain information about you as long as necessary to provide Services, comply with statutory requirements, or meet regulatory obligations. Users may request deletion of data, subject to legal and regulatory requirements. Data will be securely deleted using approved destruction mechanisms. Please note that deletion of certain data may limit your ability to use our Services.

5. Sharing of Information

Nexiloans does not rent, sell, or otherwise disclose your personal information to third parties, except in the following circumstances:

  • With your explicit consent.
  • With financial institutions, banks, co-lending partners, and service providers for service delivery.

6. Cross-Border Data Transfer

Where your data may be stored or processed outside India, such transfer will be undertaken in compliance with applicable law, and subject to appropriate safeguards to ensure adequate protection. By using our Services, you consent to such transfer.

7. Data Security and Breach Management

We maintain industry-standard physical, technical, and administrative security measures to protect your personal information. In the event of a data breach, Nexiloans will promptly activate its Incident Management Protocol, take remedial actions, and notify affected users in accordance with applicable guidelines and legal requirements.

8. User Rights

You have the right to access, review, correct, and update your personal information at any time. You may also withdraw consent for data processing or request deletion of your information, subject to legal and regulatory obligations. Exercising these rights may limit or prevent our ability to deliver Services to you.

9. Minors’ Data

Our Services are intended only for individuals who are 18 years of age or older. We do not knowingly collect personal information from minors. If we become aware that such information has been collected, we will delete it immediately upon notification.

10. Third-Party Policies

We may work with third-party service providers in connection with the App or for providing our Services. Please note that when you interact with such third parties, their own privacy policies will apply. We recommend that you review their policies to understand how your information will be handled. Nexiloans will not be liable for any acts or omissions of third-party service providers.

11. Changes to this Privacy Policy

This Privacy Policy may be updated from time to time to reflect changes in our practices or legal requirements. Any updates will be communicated via your registered email and will also be posted on our Website/App.

This Privacy Policy forms part of the Terms of Use of Nexiloans’ Services and is legally binding on all users.

Annexure 1 – Permissions Required

For the functioning of the Nexiloans App and provision of Services, the following permissions may be requested from your device. Such permissions will only be accessed with your consent and in accordance with this Privacy Policy:

1. Camera & Microphone

We may require access to your device's camera and microphone for purposes such as capturing your selfie, uploading photographs, recording audio/video for KYC verification, and for uploading necessary documents required in connection with your loan application.

2. Phone Storage

We may require permission to access your device storage in order to allow you to upload documents, such as proof of identity, address proof, bank statements, or other necessary supporting documents for loan processing and verification.

3. Location Services

We may collect and monitor your location details to verify your current address, assess serviceability, detect unusual activity, and prevent fraudulent transactions. Location data is only collected if you enable such access on your device.

4. Device Information

We may collect device-related information, such as IP address, browser type, operating system, hardware model, software version, and unique device identifiers. This information helps us uniquely identify devices, prevent unauthorized access, and detect fraud.

5. SMS

We may read SMS headers from 6-digit alphanumeric senders to verify financial transactions and assess creditworthiness. We do not read or analyze personal SMS content or OTPs other than those sent by Nexiloans. Information such as sender name, SMS header, and timestamp may be collected to support credit evaluation and fraud detection.

6. Device ID & Status

We may request permission to access device ID and phone status in order to verify your identity. This helps establish the authenticity of digital transactions and link the device with the customer’s identity.

13. User Consent for Permissions

By installing, accessing, or using the Nexiloans App and Services, you explicitly consent to the collection and use of your personal information and device permissions as described in this Privacy Policy, including but not limited to the permissions listed in Annexure 1. Such permissions shall only be accessed after obtaining your consent through the App’s permission request prompts.

You may withdraw your consent at any time by revoking such permissions in your device settings or by contacting us. However, please note that certain Services may not function properly, or may become unavailable, if specific permissions are denied or withdrawn.
